New Delhi: The Bombay High Court has dismissed the complaint lodged against singer Kailash Kher. He was accused of hurting religious sentiments from his song ‘Bam Lahiri’ dedicated to Lord Shiva. The bench of Justice Bharti Dangre and SC Chandak ruled that Anupam Kher had no deliberate or malicious intention to hurt religious sentiments. He sang only the song that praises Lord Shiva and his qualities.

The complaint against Kailash Kher was originally filed by Narinder Makkar in a court in Ludhiana under sections 295A and 298 of the IPC, alleging that the music video showed fewer clothes and intimate scenes, which were objectionable to Shiva devotees. However, the High Court said that every work that is disliked by a group is not necessarily hurting religious sentiments. The bench said, ‘Indian society has been a problem of Indian society for centuries. But this is in the acceptance of the right to disagree, which separates an independent society.

Court pronounced decision in the interest of artist
There was only a allegation against Kailash Kher that he appeared in a video in which women were in objectionable dress according to the complainant. However, the court noted that Kailash Kher was only singing songs and the video was choreographed and made by another company. Kailash Kher moved the High Court in 2014 when the case was first registered and the court gave him interim relief from any action. In the petition filed through his lawyer Ashok Sarogi, Kailash Kher argued that he was only a singer and had no role in making the video. The video was approved by the censor board before its release. The Bombay High Court has once again proved that the artists have complete freedom to perform their art. No one can be banned just because some people do not like it.
