answer- Advocate Ravi Ranjan Mishra explains that the traffic police has the right to stop drivers and check the vehicle documents or ask questions. If you have been asked to stop, it does not mean that you have done something wrong. The traffic police can also stop drivers just for routine questioning. So if you have not broken any traffic rule and the traffic police stops you, then keep these things in mind-

Question- What powers does the traffic police have?

answer- Like drivers, traffic police also have some special powers as per the law, which they use to enforce traffic rules or maintain road safety. Traffic police can charge a fine or seize a vehicle for violating traffic rules and if the vehicle documents are not complete. Apart from this, arrest can also be made in case of misbehavior with traffic police.

Question: What kind of behavior cannot the traffic police do with drivers?

answer- If you are following traffic rules, then there is no need to be afraid of the police. The traffic police can stop you and ask for questioning or proper documents, but this does not mean that the policeman should misbehave with the driver in the name of vehicle checking. If this happens, the driver can complain against the traffic policeman to higher authorities.

Question: Can a policeman take away the keys of your car or bike?

answer- If you are cooperating during checking, you can refuse the police officer from taking out the keys. No police officer can snatch the keys of a two-wheeler or four-wheeler. A Right to Information (RTI) was filed by advocate Pawan Parikh regarding this, in response to which it was clarified that no matter what rank the traffic police officer is, he does not have the right to forcibly take out the keys from the vehicle.

Question: If you have been issued a challan for violating traffic rules, what things should be kept in mind?

answer- A challan is issued by the traffic police for violating traffic rules or for not having official documents. It serves as a legal proof of the offence, which states the amount of the fine. In case of a challan, it is important to obtain a receipt as delay in paying the challan may result in higher fines, license suspension or vehicle seizure.

If your vehicle has been challaned by the traffic police, then definitely check these things in the challan. Such as-

  • Check every detail given in the challan carefully. Check whether the fine amount is written according to the traffic rule you have violated or not.
  • Also confirm the details of the court where the challan is to be settled.
  • Try to pay your challan immediately. This often leads to a discount on the penalty amount. Many states also have the facility of online challan payment to make this process easier.

Question: Where can I complain against a traffic policeman?

answer- Advocate Ravi Ranjan Mishra says that if a traffic policeman misbehaves or misbehaves with you in any way, you should behave with him with caution and politeness. During this, remember the name and number written on the badge of the traffic policeman. After this, you can make a written complaint about the matter by sending an email to the DCP Traffic or any other senior officer or by visiting their office.

answer- According to the Helmet Regulation and Law in India, it is mandatory for all two-wheeler drivers in the country to wear helmets. According to section 129 of this rule, driving a two-wheeler without a helmet can result in a fine of Rs 5000 and the driving license can be suspended for three years. However, if a Sikh person wears a turban while driving a bike or scooter, then he is allowed to ride the bike without a helmet.

Apart from these, if a person has undergone any surgery on the neck, due to which he has trouble wearing a helmet, then he is also exempted from wearing a helmet. However, for this the person will have to show the documents related to the surgery as proof.
